[ARCHIVED] Marijuana Regulation Process

Cannabis Ordinance Current Status: The second reading of the local cannabis ordinance is planned for Tuesday, November 14, 2017.   

November 14, 2017 - Staff Report, Ordinance:  The second reading of the local cannabis ordinance is planned.  


October 24, 2017 - Staff Report:  The cannabis ordinance was discussed and introduced for first reading by title only.  City Council made some modifications to the proposed ordinance, which were included in the introduction and first reading:

  • Section 9.06.040(A)(5) - Personal cannabis cultivation permit requirement concerning site plan and floor plan no longer requires plans to be "scaled," and clarification that "dimensioned hand sketch acceptable" was added.
  • Section 5.50.120(L) - Section to now read as follows: "Retail medical operations shall not have a physician or any person licensed to recommend medical cannabis for medical use, at the location of the commercial cannabis operation, to provide a recommendation or physician's recommendation, for use of medical cannabis."
  • Section 5.50.120(C)(2-3) and Section 5.50.130(C)(2-3) - Buffer zones restricting business locations modified by removing "religious institution" and by adjusting buffer zone from "park" to 100 feet.   


October 10, 2017 - Agenda and Staff Report:  City Council directed staff to prepare the cannabis ordinance, generally allowing two medical dispensaries in C1 - Central Business, C2 - General Business, and M-1 Light Industrial Zones and allowing medical cannabis delivery, while banning aspects of cultivation, manufacturing, testing and recreational cannabis delivery.


August 8, 2017 - Staff Report, Police Report, Slideshow, City Council Video:  Staff presented City Council with recommendations from the Marijuana Sub-committee to develop the future marijuana ordinance.  One of the highlights from the meeting was, Council discussed limiting the number of dispensaries to two medical businesses, with the possibility of allowing one of the dispensaries to be a recreational marijuana business.  Staff will draft the first revision of the marijuana ordinance and plans to present it to City Council on October 10, 2017.


June 14, 2017 - Staff Report, Community Input:  City Council reached out to the community through a public forum.  The workshop allowed the community to express their opinion on allowing, regulating or banning, certain aspects of Proposition 64 through stickers and comments to Council and staff.


April 11, 2017 - Staff Report, Slideshow:  Staff presented marijuana survey options and City Council moved not to conduct the survey, but to hold a public workshop on the topic.


March 1, 2017 - Staff Report, Slideshow:  The Assistant City Attorney presented a robust educational workshop on Proposition 64.  City Council provided direction to staff to create a survey for public input.  The Marijuana Sub-committee was formed and Councilmember Marlys McPherson and Robert 'Red' Davis were appointed.


January 24, 2017 - Staff Report, Slideshow :  Staff presented a summary of Proposition 64.  City Council agreed a study session was needed to gain a better understanding.  Council requested an educational session on the topic.
